Terms of Service

MyGiveKit is a software-as-a-service platform designed to help nonprofits, schools, PTOs, churches, and community organizations run silent auctions, fundraisers, volunteer signups, and donor management. MyGiveKit is operated by Nelson Consultants Corp (“we,” “us,” or “our”).

You must be at least 18 years old and have the authority to bind your organization to these terms. By using MyGiveKit, you represent that you meet these requirements.

MyGiveKit is intended for use by legitimate nonprofit organizations, schools, churches, and community groups. We reserve the right to terminate accounts that use the platform for fraudulent, deceptive, or unlawful purposes.

You are responsible for maintaining the security of your account and all activity that occurs under it. We use magic link authentication — keep your email account secure.

You may invite team members to your organization. You are responsible for all actions taken by users you add to your organization.

MyGiveKit offers two plans:

• Free: Create and configure events at no cost. Includes one trial live auction and limited usage across all features.
• All Access ($29/month or $249/year): A recurring subscription that removes all usage limits — unlimited live auctions, items, bidders, fundraisers, newsletters, and more.

Payment is processed by Stripe. By subscribing to All Access, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel at any time from your billing settings — you’ll retain access through the end of your current billing period.

All fees are non-refundable except where required by law. If you have a billing dispute, contact us at hello@mygivekit.com within 30 days of the charge.

MyGiveKit does not process auction payments on your behalf. We provide bid tracking, winner management, and notifications. Collecting payment from winning bidders is your organization’s responsibility using your preferred method (Venmo, PayPal, check, or Stripe Connect if configured).

We are not responsible for any payment disputes between your organization and your event attendees.

You retain ownership of all data and content you upload or create in MyGiveKit, including event details, item descriptions, and bidder information.

You grant us a limited license to store, process, and display your content solely for the purpose of providing the platform to you.

You are responsible for ensuring that your use of the platform — including your auction items, bidder data, and event communications — complies with all applicable laws, including those governing fundraising, gaming, and data privacy in your jurisdiction.

You may not use MyGiveKit to:

• Conduct fraudulent, deceptive, or illegal fundraisers
• Collect money under false pretenses
• Violate any applicable laws regarding raffles, lotteries, or gambling
• Harass or harm auction participants
• Attempt to reverse-engineer, scrape, or interfere with the platform
• Resell or white-label the platform without written authorization

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.

We recommend scheduling critical auction close times during off-peak hours and having a backup communication plan with your bidders.

The platform is provided “as is” without warranty of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, MyGiveKit’s total liability for any claim arising from your use of the platform is limited to the amount you paid us in the 12 months prior to the claim.

We are not liable for any indirect, incidental, special, or consequential damages, including lost revenue from your fundraiser.

You may cancel your account at any time. We may suspend or terminate accounts that violate these terms, with or without notice.

Upon termination, your data will be retained for 90 days before permanent deletion, during which time you may export your data upon request.

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance.

These terms are governed by the laws of the state where Nelson Consultants Corp is incorporated, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction.
